Sell an inherited house in Albuquerque, even from out of state.
Losing a parent or family member is hard enough. Selling their Albuquerque house from another state, while juggling probate and a lifetime of belongings inside, shouldn't make it harder. We work directly with NM probate attorneys and close as soon as the legal process allows — typically 30 days or less from authorization to wire.
How we make inherited sales easier
- We coordinate with your probate attorney. If you don't have one yet, we can refer you to local New Mexico probate counsel.
- You don't have to fly out. We close by remote notary, mail-away packet, or e-sign — whatever works for your state.
- Leave anything behind. Boxes of photos, decades of furniture, dad's tool collection. We handle cleanout. You only need to take what you want.
- No repairs, no painting, no staging. The house can be in any condition — including hoarder situations or long-vacant properties with deferred maintenance.
- One offer, all heirs. If multiple beneficiaries are involved, we deliver a single written offer everyone can review and sign.
Probate basics in New Mexico
If your loved one died with a will, the estate will likely go through informal probate in the New Mexico district court for the county where they lived. Bernalillo County (Albuquerque) and Sandoval County (Rio Rancho) handle thousands of these cases per year. The court appoints a Personal Representative — usually the executor named in the will — who has authority to sell the property.
If they died without a will (intestate), New Mexico's intestacy statute determines who inherits. The court still appoints a Personal Representative, but the process can take longer.
If the property was in a living trust or transferred via a Transfer-on-Death (TOD) deed, you can usually skip probate entirely and sell immediately.
Common Albuquerque inherited-house situations
- Out-of-state heir, vacant ABQ house — utilities, lawn care, and break-in risk are mounting. We close fast and you stop the bleed.
- Hoarded house — clearing it would cost $10–30k and weeks of work. We buy as-is, with everything inside.
- Sibling disputes — once probate authorizes the sale, our written offer gives everyone a single number to agree on.
- Reverse mortgage on the deceased's house — heirs typically have 30 days to decide, with extensions to 12 months. Selling to us pays off the reverse mortgage in full and any remaining equity goes to the estate.
- Property tax delinquency — Bernalillo County tax sales move slowly but don't wait. We resolve any back taxes at closing.
What about capital gains tax?
Inherited properties get a stepped-up cost basis as of the date of death. That usually means you'll owe little or no capital gains tax when you sell, even if your parent bought the house in 1985 for $40k and it's now worth $300k. Talk to a CPA, but this is generally great news for inheritors.
